Default OT Man Shoots Lawyer

There it was on The CBS News with Dan. In prime time, a man shoots his
lawyer. BANG, the lawyer ducked. BANG, the lawyer cringed behind a tree.
BANG BANG BANG. Hooray! Oh Joy, what a delight. Thank you Ja! There is
universal justice. From L.A. to Boston squeals of delight erupted from
millions of victims. In the oaken chambers of prestige law firm, nervous
counselors shook their learned heads in shock and horror. Has a new
president been set? Dissatisfied with your lawyer? Shoot he *******! Anyone
have an AVI file of this memorable moment?

Lyndon Johnson was sworn in on Air Force One after PRESIDENT Kennedy was
shot.

I'm assuming you mean precident? (laughing)

It's not funny. It didn't make the CBS news, but some dude here in Memphis
shot his attorney after the man didn't manage to get him an acquittal or not
guilty verdict. After he got out of prison, he hunted down the attorney and
gunned him down. The defendant had an arrest/conviction record longer than
a yardstick (even if you don't count juvenile convictions). Yeah, I'd
rather have THAT guy running loose on the streets than the attorney.

It isn't funny and is one of the reasons getting into a courthouse is a
major pain in the ass.

And I'm not going to hold attorneys blameless in this. Friend of mine
was riding with a friend one day when and 18 wheeler decided to occupy
the same lane. He ended up with some nerve damage and his attorney is
one of those who rarely contacts him. Been close to 3 years now.

What's complicating things is that he had to abrogate his claim through
his friends insurance co. Both are being represented by the same lawyer.
So he's dragging his feet.

There's frustration abound - my attorney friend laments the process of
getting those acquitted to pay their bills.

So expect an attorney to go off the wall somewhere soon. It's brewing.

There are lots of good lawyers out there. Unfortunately, there are lots
of bad apples that give the profession a bad name. I deal with lawyers
and paralegals on a regular basis, and I find that the paralegals are
much easier to deal with and do a much better job of representing their
clients interests. I certainly don't think that (most) lawyers deserve
to be shot, but I appreciated the old joke about 100 lawyers at the
bottom of the ocean being called "a good start". But then there are no
lawyer jokes, because they are all true :-)

I'm sorry to disagree, but IMHO every lawyer is "armed"... holding others
lives in their hands... some (many?) guilty... some (many?) innocent... not
just the accussed, but also the lawyers themselves!!!

I'm not saying that the shooting was right/wrong... I'm just saying that
I've known innocent people who have been sentenced to life (death?) due to
poor representation from crummy lawyers.

Q: What do you call a thousand lawyers at the bottom of the ocean?
A: A good start.

NEW YORK (Reuters) --Cell phone users have been known to complain about poor
service, but one New York man's mobile literally went down the toilet.

The man was on a suburban train from Grand Central Station on Wednesday
night
when he went to the bathroom to make a phone call, dropped the phone into
the
toilet bowl and then his hand and arm became stuck trying to retrieve it,
officials said.

Metro-North Railroad staff could not help the man, so they stopped the train
and
called police officers and firefighters to extricate him, a process that
took 90
minutes using "jaws of life" rescue equipment.

"The toilets are made of aluminum so I imagine he was down on hands and
knees
with his shirt rolled up and hand and arm down inside, trying to flush out
his
cell phone," said Jim Cameron of the Connecticut Metro-North commuter
council.

He said that because of the design of the train toilet, the mobile probably
ended up in a chemical holding tank.

A spokesman for the railroad that serves the northern suburbs of New York
and
Connecticut identified the man as Edwin Gallard, 41, of New York, who
suffered a
minor injury to his arm as firefighters cut the toilet apart.

The track was closed and thousands of commuters were delayed during the
evening
rush hour.

The phone has not yet been recovered.

According to the Los Angeles Times, The shooter, William Strier, was not
this lawyer's client. The two were adversaries in a dispute over a trust
fund that had been established with money Strier received in an injury
settlement. Streir was angry over money drawn from his trust fund to pay the
attorney representing the trustee who had been appointed by the court to
manage the trust fund. The lawyer had come to court on Friday for a hearing
on a request for an additional $6200 from Streir's trust fund for the
trustee and for himself. Strier claimed that in addition to depleting his
trust fund, the trustee and lawyer were responsible for witholding money
that was needed for his medical care.

Also, that Strier had been making threats to the trustee, who was
trying to transfer the trusteeship to Strier's sister.

What a sad commentary on society that people take delight when someone
shoots someone else, even a lawyer. No wonder our society (American) is so
violent. This sets a terrible example for children.

I saw the story on the news too. It was horrible. Fortunately, the shooter
was apprehended without further incident. The lawyer apparantly got on his
client's shit list as a result of getting him a lessor monetary settlement
in some civil litigation than the guy had hoped for.

I am no expert, but it sounds like your friend's attorney has a serious
conflict of interest in handling your friend's case if he's also
representing the defendant. Your friend would do well to file a complaint
with the local bar association in his area.

What I've found is that most lawyers won't admit they can't do something
well -- far higher percentage than in any other profession I'm aware of.
I'm a nurse, very experienced, but there are tons of nursing jobs I
couldn't do well without extensive training even though I'm technically
qualified. I've had plumbers, electricians, and general home repair
people tell me, when I phoned asking if they could do a certain job,
that I'd be better off calling a different specialty or a different
company. Physicians advertise themselves by specialty. Even store
employees, when telling me they don't carry what I'm looking for, often
have a suggestion as to who might have it. Yet every attorney I've ever
dealt with has insisted they could do whatever I wanted regardless of
their background. I understand that being in independent practice means
one has to be somewhat flexible, but if they were truly motivated to
provide the best possible service, they should be honest enough to say
"Joe Smith is the best at homeowners association issues" or "I'm very
good at wills and contracts, but you would probably be better off with
Clark & Clark to fight your DUI." I'd have more respect for the
profession if most of its members accepted their limitations.

Your problem is that you make this statement about one profession, not all.
