Just Mayo Spread Violates Mayonnaise and Label Rules, F.D.A. Says

The Food and Drug Administration has told Hampton Creek, a tiny company
selling plant-based replacements for proteins derived from animals, that
some of its Just Mayo products violate federal regulations related to
standards for mayonnaise and proper labeling.

In a letter dated Aug. 12, the agency wrote that even the term €śmayo€ť in
the brand name and the logo, a minimalist egg €ścracked€ť by a pea shoot,
€śmay be misleading to consumers€ť by implying there are eggs in the products.

€śThe term "mayo has long been used and understood as shorthand or slang
for mayonnaise,€ť William A. Correll Jr., director of the F.D.A.s office
of compliance for food safety and applied nutrition, wrote in the
letter. The agency also said that Just Mayo and Just Mayo Sriracha
contained too much fat for the company to imply that they were €śheart
healthy.€ť

The federal standards of identity for food require that any product
called mayonnaise contain eggs, which neither Just Mayo nor Just Mayo
Sriracha does. In addition, the letter said:

€śWe also note that these products contain additional ingredients that
are not permitted by the standard, such as modified food starch, pea
protein and beta-carotene, which may be used to impart color simulating
egg yolk. Therefore, these products do not conform to the standard for
mayonnaise.€ť

The F.D.A. issues dozens of warning letters to food companies each year
about potential violations it finds with their labeling.

Josh Tetrick, the companys founder and chief executive, said he spoke
with an F.D.A. official on Tuesday about the agencys concerns. €śIt was
a good conversation, and were going to write an honest, thoughtful
letter back to them, as they suggested,€ť Mr. Tetrick said. €śApparently,
there are often gray areas when it comes to these things, and they
sounded very open to digging into this with us.€ť

Ivan Wasserman, a specialist on food advertising and labeling who is the
managing partner in the Washington office of Manatt Phelps & Phillips,
said Hampton Creek was likely to have a tough time persuading the F.D.A.
to let the companys labeling stand as is.

€śThe company and the F.D.A. may have a back-and-forth and come to an
agreement about modification of the label, but certainly it does seem
that the F.D.A. is on fairly strong footing,€ť Mr. Wasserman said.

For the last several years, the egg industry has been worried that
Hampton Creek will cut into egg sales, according to emails and documents
obtained through the Freedom of Information Act by Ryan Noah Shapiro, a
graduate student at the Massachusetts Institute of Technology who has
become somewhat of an expert at using the law to obtain documents.

And in fact, some companies have begun adopting the companys products
in the wake of the avian flu epidemic that devastated the egg industry
this spring and summer.

Hampton Creeks plant-based spread also has dented sales of conventional
mayonnaise, according to a lawsuit Unilever filed against the company
last year. The lawsuit raised some of the same issues about Hampton
Creeks labels that the F.D.A. is raising, but Unilever dropped it.

This would not be the first time Hampton Creek has run afoul of federal
food labeling regulations, which are esoteric and complex. In a recent
article about the company on Business Insider, a news website, unnamed
former employees complained that it had used the phrase €ślemon juice€ť on
its labels rather than €ślemon juice concentrate,€ť as required by federal
labeling laws.

Mr. Tetrick later posted a response, that, among other things,
apologized for using the wrong terminology for juice and said he had
moved €świthin days€ť of being told about the issue by an employee to
order a change in the language on the labels.

The F.D.A. said nothing about lemon juice in its Aug. 12 letter. It said
it had been studying the labels for Just Mayo and Just Mayo Sriracha
since June.

There is a great irony in the world of business. They talk about
capitalism and free enterprise and the need for competition to force
industry to be more efficient and competitive and to keep prices down.
Then they go around and buy up the competition. So much for the value of
competition. Capitalism seems to have a lot more to do with making money
off money and by buying businesses to sack their assets than it does
with efficiency in production.

The first time I tasted it, was at Whole Foods but even Safeway
carries it now. Your version of Safeway in Southern Cal is Von's
isn't it? Try looking for Just Mayo there.

Target has it and I have heard that Costco has it but I haven't seen it
here.

I tried it, and went back to Hellman's. It tasted... lentil-ish or
something. Not what I'm looking for in mayonnaise. If I want a
more lemony flavor, I'll add lemon.

Sauer's is good but I stick to Hellman's mostly.
"Bring out the Hellman's and bring out the best."

Their prices bounce up and down so much here though. One week they
sell for $2.50. Next week they sell for up to $4.59.

Same here, which is why I don't worry about the price. When
I need mayo, I buy mayo.

On the other hand, toilet paper is worth buying a couple
extra when it's on sale. Doesn't go bad, always will be
needed. If I cleaned out my basement, I probably could
store a year's worth, but there would be no point. It's
on sale regularly.

A bottle for us would be a 2-year supply. We've used Kewpie for many
years now. But as I say, we don't use it often.

It's put that way for us to know it's cane sugar ALL the time. Just
saying "sugar" means they bounce back and forth between beet (which I
would rather not buy) and cane, depending on price.

The egg is just an outline and a plant is growing inside the shape at
the base. I think it depicts the ingredients perfectly. A plant
based product that gives an illusion of egg.

I've never tried that brand, can't say I've ever seen it on the shelf.
Is it the mayo that goes with walnut shrimp in Chinese restaurants? I
ask because it's "different", not that I want to rush out and buy it.
