Every time I get the slightest sniff that UPSDHLFedex won't be
able to get the package into my hands in a seamless manner, I
call and tell them to "hold for pickup".

Probably adds $100 of my labor to the effective cost of
a $20 service, but I've yet to miss an important package
that way.

In fact, barring a second day of Ohio-snow plane problems,
I'll be snagging one tomorrow that had originally been
addressed to my office.

Well Brown does a hell'uv a good job delivering to my house. The post
office refuses to deliver here at all. Also Fed Ex and airborn deliver
here but not uncle sam, they are just too busy thinking up ways to make
their service even worse than it is now.

They'll do that for you? When I've called UPS or Fed Ex to do this,
they've refused, saying they have to attempt to make delivery. When I
tell that there won't be anyone home for over a week, they don't care.

I've never had that problem. Maybe it depends on when you call.

I've called when the shipping has delayed so long to get it out,
delivery will occur after I leave town. I've called UPS or Fed Ex before
the package even gets into the state, and they've said that only the
shipper can modify delivery; otherwise, they must attempt delivery at
least once. For things that don't have a signature requirement, I've
told them that if they leave it at my door and it isn't there when I
finally get back, I'll hold them responsible. They didn't care.

You can't. Their contract is with the shipper, not you. You can hold the
shipper responsible, if it was part of the shipping order, but they
dictate those terms.

Simply - you lose. The don't care.

You can't. Their contract is with the shipper, not you. You can hold the

They have a contractual responsibility to ensure safe delivery. In such
a case, they were alerted to the fact that they would not be able to do
so, and chose to ignore the warning. Even if they are on the hook with
the *shipper* as a result, I will not be the one to bear the burden.

Unless they have prior notice that there is no safe place to leave it.
They owe a duty to make reasonable efforts to effect safe delivery, and
they fail that duty by delivering to a location that they have been
notified will put the package at risk.

With shipments requiring no signature the customer (you) bears no
responsibility whatsoever, all liablity is between shipper and carrier...
without signature if the package is lost, stolen, and/or damaged resolving the
matter is strictly between the carrier and shipper. Most shippers these days
opt for no-signature delivery for shipments under certain dollar value to save
on shipping costs, of which the customer (you) receives no monetary benefit but
also bears no burdon.

I've had many shipments arrive late even though I've paid for "express"
delivery... I'm still responsible to pay for the product but have had the
"express" charge deducted, and most mail order/dot.com companys will then also
refund the entire shipping charge rather than risk losing a customer. In fact
when you're a steady customer all you need do is ask and most of the major
companys will drop the shipping charge when the order is placed, just be sure
to place your order with Customer Service during normal business hours, the
ordinary order takers are outsourced and have no authority.
